When school districts and parents are unable to come to an agreement regarding a child’s educational plan, a parent should strongly consider having a Special Education Attorney file a Due Process Complaint (or impartial hearing request). The resulting Due Process Hearing (or impartial hearing) is an administrative proceeding, much like a trial, where both sides present their cases before an Impartial Hearing Officer (IHO), who then makes a decision on what would allow the child to progress in school/what the child needs going forward.
