Due Process Hearings

Due Process Hearings

Have you reached an impasse with your school? Has the CSE come up with a plan that is not adequate to meet your child’s needs?

If you are unable to come to an agreement regarding your child’s educational plan, you should strongly consider having GDPC file a Due Process Complaint (or impartial hearing request) on your behalf. The resulting Due Process Hearing (or impartial hearing) is an administrative proceeding, much like a trial, where both sides present their cases before an Impartial Hearing Officer (IHO), who then makes a decision on what would allow your child to make progress in school/what your child needs going forward. And how your family should be compensated for the past.

Know your rights. Allow GDPC to explain just what your child is entitled to. And if a complaint must be filed in order for your child to get what he or she deserves, let us lead you through the process.
