Manifestation Determinations

Every child’s special needs are unique and manifest themselves differently. When a child acts out or behaves badly in school, it may be a manifestation of his or her disability. A child may be entitled to a manifestation determination before any decision to punish or otherwise remove the child from school is made. Such a determination may lead the school to drastically reduce or eliminate punishment altogether. If it is determined that a child’s behavior is a manifestation of his/her disability, the child’s educational program and placement (services included) should be closely reviewed and amended appropriately, if warranted.
